Can AT&T distinguish between tethered and untethered data?

iPhone 4 latest 4.3.2 update (standard 16GB device and not! Jailbroken)

Is tethering applicable to 3G, wifi or both? Looking for some technical details that either support or disprove AT&T ability to crack down on jailbroken devices.

Your post confirms they can tell when someone is tethering without the correct feature. I suspected they could, just couldn't provide proof.

FWIW, ATT is not cracking down on jailbroken devices per se (they could care less), but rather the inappropriate use of their data network. One takes away from their potential revenue while the other does not.

It's not the device but is the issue of using a feature incorrectly that violates the Terms & Conditions of Service.
